Terms of use (draft)
This is a complete draft that describes what the service actually does, but it is not yet the binding text. A legal professional for each country reviews and approves it before launch, and the final text may differ from this draft.
1. Acceptance and parties
By using the Zahwa app or website you accept these terms and the privacy policy. The final text names the operating entity in each country, its commercial registration and address.
If you do not accept the terms, do not use the service.
2. What the service is, and Zahwa's role
Zahwa is an intermediary platform that shows licensed salons and clinics, their services and their available times, and lets you book and pay.
The service itself (beauty or treatment) is provided by the place, which is responsible for its quality, safety, licensing and keeping to the appointment. Zahwa does not provide the service, but it checks places' licences before accepting them and follows up complaints.
3. Your account
The account is personal, tied to your phone number, and for people of legal age in their country. You are responsible for the accuracy of your data and for everything done from your account, and must tell us at once if you suspect it is used without your permission.
You may add family members to book for them, provided you have the right to do so.
You can delete your account in the app at any time (see the privacy policy). We may suspend or close an account that breaks these terms or is suspected of fraud, and tell you why unless the law prevents it.
4. Booking
A booking is confirmed when the app shows it as “confirmed”, after payment if the place asks for payment or a deposit in advance. We hold the time for you for a few minutes while you complete the booking, and release it if you do not finish.
Before you confirm you see: the services, duration and price (or “set at the clinic” for some medical services), and the place's policy on cancelling, lateness and no-shows. Confirming the booking means you accept them.
Please arrive on time. A place may treat a long delay as a no-show under its displayed policy.
5. Changing, cancelling and no-shows
You can cancel your booking in the app. Cancelling within the free window the place sets costs nothing; after it, the late-cancel or no-show fee shown to you when booking may apply, and it never exceeds what you accepted.
If the place cancels or moves your booking without your agreement, we tell you at once and you get back everything you paid for it.
If you delete your account, your upcoming bookings are cancelled with no fee.
6. Prices and payment
Prices are set by the place and shown in your country's currency, including the taxes its law requires. Discounts and offers come with the conditions and limits shown.
Payment is through licensed payment gateways and the methods available in your country (such as cards, KNET and Apple Pay), or at the place if it allows that. We do not keep your card details (see the privacy policy).
If the place asks for a deposit, it is deducted from the price at the visit and follows the same cancellation policy.
7. Refunds and disputes
Refunds follow the place's policy shown when you booked and these terms. No refund happens automatically: a dedicated team reviews it and approves it with a recorded decision, then the amount goes back to the original payment method within the time the gateway and bank need.
If you disagree with the place (service quality, a fee, a service not provided), contact us within a period the final text sets from the visit date. We hear both sides and decide according to the displayed policy and the evidence, without affecting your right to go to the consumer protection authorities.
8. Medical services
Medical services are provided by clinics and practitioners licensed by the health authorities of their country, and medical decisions (suitability, the treatment plan and, for some procedures, the final price) are theirs alone.
Zahwa does not give medical advice or diagnosis and does not guarantee the result of any treatment. Information shown about services is for introduction only.
Fill in pre-visit forms honestly and accurately; they are for your safety. In an emergency call an ambulance at once and do not rely on the app.
9. Reviews and content
You can review a place only after a completed visit. A review must be honest and from your own experience, and free of abuse, defamation, personal data, other people's health data or advertising.
The place may reply to the review, and we may hide what breaks these rules. You allow us to show your review in the service.
10. Acceptable use
You may not: make fake or repeated bookings to block times, impersonate someone else, try to reach data or accounts that are not yours, disrupt the service or harvest its data automatically, or use it for anything unlawful or against public morals.
11. Partners (salons and clinics)
Salons and clinics are bound by a separate partner contract that sets the commission, how payments are collected, payouts, licensing duties, responsibilities and the protection of customer data. For partners, that contract supplements these terms.
12. Limits of liability
We take reasonable care to keep the service available and accurate, but it is provided “as is” and may be interrupted for maintenance or for reasons beyond our control.
As far as the law allows, Zahwa is not liable for the service the place provides, nor for indirect damage. Nothing in these terms limits rights you cannot give up under your country's consumer protection laws.
13. Intellectual property
The Zahwa name, logo, the design of the service and its content belong to us or our licensors. Places' photos and descriptions belong to their owners. They may not be copied or used commercially without permission.
14. Governing law and changes
These terms are governed by the laws of the country where you use the service, and its courts hear disputes, unless the final text sets otherwise for a country.
We may change these terms and tell you in the app about any material change before it takes effect. Using the service after that means you accept them; each booking stays under the policy you accepted when you made it.
